These Terms of Service (“Terms”) are a contract between you and TENSHN LLC, a Georgia limited liability company (“TENSHN,” “we,” “us,” or “our”), 8735 Dunwoody Place Ste. R, Atlanta, GA 30350. They govern your use of tenshn.com (the “Site”), your purchases from us, and the Scalp Passport mobile application (the “App”).
By placing an order, checking the box that says you agree to these Terms, downloading or using the App, or using the Site, you agree to these Terms and to our Privacy Policy, Shipping Policy, Refund Policy, and, if you buy a subscription, Subscription Policy, all of which are part of these Terms. If you do not agree, please do not use the Site, the App, or our products.
Eligibility. You must be at least 18 years old to use the Site, place an order, or use the App.
TENSHN sells grooming instruments and cosmetic oils for external use on the scalp, neck, and back. Our products are cosmetic and grooming tools. They are not intended to diagnose, treat, cure, or prevent any disease or condition, and are not marketed or intended as a treatment for hair loss or as a hair growth product. No statement on this Site or in the App has been evaluated by the U.S. Food and Drug Administration. Individual experiences vary.
Safety. Do a patch test before first use of any oil. Do not use products on broken, irritated, or sensitive skin, and keep them away from your eyes. If you experience irritation or an adverse reaction, stop using the product and consult a physician. Do not share tools. If you have a concern about your hair, skin, or scalp, or a medical condition, talk to a qualified healthcare professional; nothing we provide is a substitute for professional advice.
Scalp Glove: hair entanglement. The Scalp Glove is not designed for long hair. It has free-spinning steel balls (rollers) that can catch and wrap hair, jewelry, or clothing. Use it only on bare skin or on hair short enough that it cannot wrap around a roller. Do not use it on long or loose hair, and keep jewelry and clothing clear of the rollers. If anything catches, stop moving, slide the glove off your hand, and gently unwind or cut the hair free. Do not pull. Stop using the Scalp Glove if it causes pain, pulling, or any skin injury, and keep all tools out of the reach of children.
Shipping is covered by our Shipping Policy, returns and refunds by our Refund Policy, and recurring purchases by our Subscription Policy.
License. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control (and on other platforms if and when we make the App available for them), for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease the App; reverse engineer or try to extract its source code, except as the law allows; remove any notices from it; or use it to build a competing product or dataset.
What the App does. The App helps you photograph and track the visible appearance of your scalp over time and log habits such as massage routine, sleep, time outside, exercise, meditation, nutrition, and steps. Its readings are visual estimates for observing change over time. The App is a general-wellness tool. It is not a medical device, it does not diagnose, treat, or predict any condition, and it must not be relied on for medical decisions. Results depend on lighting, your camera, and how you frame each photo, and may be inaccurate.
Your data. As described in our Privacy Policy, your photos are analyzed on your device and are not kept, and your readings and logs stay on your device. We do not own your data and receive no license to it, except as you may expressly agree in a separate written consent. You are responsible for the security of your device.
The App and its content are provided as a complimentary companion to TENSHN products. Some features and tutorial content are available only while you hold a qualifying TENSHN purchase, which we may verify against your purchase records. In summary:
We do not sell anything inside the App. Purchases are made only on tenshn.com. Apple and Google are not parties to your purchase.
The App, and access to it, is available at the discretion of TENSHN and may be cancelled, suspended, placed on hold, changed, or discontinued at any time, with or without notice, at the discretion of TENSHN, acting through its owners, managers, and managing members. TENSHN reserves the right to delete the App, remove it from any app store or other channel, or put it on hold whenever it chooses, and to end or limit anyone’s access to it.
Because the App is provided as a complimentary companion to our products and is not a separately purchased product, its cancellation, suspension, hold, or discontinuation does not by itself entitle you to a refund of products you have received. If you have a subscription, you may cancel it at any time under the Subscription Policy and you will not be charged again after you cancel.
Your App data is stored on your own device. If the App is removed, put on hold, or discontinued, TENSHN cannot restore or export that data for you. Do not rely on the App as the only record of anything you want to keep.
Videos, images, text, and other content on the Site and in the App are owned by TENSHN or its licensors. Tutorial videos are licensed to you for your own personal, non-commercial viewing only, tied to your account — this license does not transfer to anyone else, even another member of your household. You may not download, record, screen-capture, copy, reproduce, redistribute, publicly display, upload, or otherwise share tutorial videos or any portion of them, by any means. Videos may carry a watermark that identifies your account.
Sharing or redistributing tutorial videos is both a breach of these Terms and copyright infringement. If we detect misuse, we may immediately suspend or terminate your access without refund, and we reserve all other remedies available to us under law, including injunctive relief and damages.
You agree not to misuse the Site or the App. That includes breaking the law; interfering with their normal operation or trying to gain unauthorized access to our systems; accessing them by automated means to scrape content; introducing malware; giving false information; or using them to harm others. We may suspend or end access for violations.
All content on the Site and in the App, including the TENSHN and Scalp Passport names, the logo and app icon, product photography, video, software, and copy, is the property of TENSHN or its licensors and may not be used without our prior written permission. If you send us feedback or ideas, you grant us a perpetual, royalty-free license to use them without obligation to you.
Checkout is provided by Shopify, and the App is distributed through Apple’s App Store (and other stores, if we offer it there). Their terms and privacy policies apply to their services. We are not responsible for third-party services.
To the fullest extent permitted by law, the Site, the App, and our content are provided “as is” and “as available,” and TENSHN disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App’s readings are accurate or that the Site or App will be uninterrupted or error-free. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
To the fullest extent permitted by law, TENSHN and its owners, managers, managing members, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Site, the App, or our products. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and $100. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence or for fraud.
To the extent permitted by law, you agree to indemnify TENSHN against claims, losses, and expenses arising from your violation of these Terms or your misuse of the Site or the App.
Informal resolution first. Email support@tenshn.com with a description of the dispute. We will try in good faith to resolve it within 60 days.
Binding arbitration. If we cannot resolve it, any dispute arising out of or relating to these Terms, the Site, the App, or our products will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either of us may bring an individual claim in small-claims court and either of us may ask a court for an injunction to stop misuse of intellectual property. The arbitration may take place by video or in your county of residence. The Federal Arbitration Act governs this section.
No class actions. You and TENSHN each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.
Opt out. You may opt out of arbitration and the class-action waiver within 30 days after you first accept these Terms by emailing support@tenshn.com with your name and order number. If you opt out, the courts described below will resolve disputes.
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law principles. Subject to the arbitration section above, disputes will be brought in the state or federal courts located in Georgia, and you consent to their jurisdiction.
You may stop using the Site and the App at any time. We may suspend or end your access to the Site or the App, or cancel an order, for breach of these Terms or as we need to operate the business. Sections that by their nature should continue after termination will continue.
We may update these Terms from time to time. We will post the new date here and, for material changes, give notice by email to purchasers or in the App. Continued use of the Site or App after changes are posted constitutes acceptance of the updated Terms. Changes do not apply to disputes already begun.
